Your Client’s Personal Chattels

The Office of the Public Guardian (“OPG”)  Deputy Standards 2017 has now made it clear that Deputies must have regard to a client’s personal chattels when managing their property and financial affairs. The 2017 Standards state a Deputy, “ must consider whether it is appropriate for items of sentimental value to be provided for the client where they now reside”.

Clear Guide appreciates that the costs and time associated with visiting your client and their properties  is often disproportionate and too costly for a solicitor to justify.

Our social workers are experienced in assisting clients in identifying the chattels they would like to have with them at their new home or perhaps even gifting to loved ones.

Clear Guide are able to:

  • Carrying out Mental Capacity Assessment to establish if your client is able to make decisions regarding their personal chattels
  • Coordinate a Best Interests Meeting regarding chattels
  • Complete COP3 if an application to the Court of Protection is necessary regarding gifting or sale of items specifically gifted under a Will
  • Assist the client in returning home (if possible) to identify any items of sentimental value
  • Take photographs of the chattels and working through them with a client if they are unable to return home
  • Collecting and delivering chattels to client
